This document is published in accordance with Rule 3(1) of the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021, requiring publishing rules, regulations, privacy policy, and Terms of Use for access or usage of the platform.

Agreement to Terms
By accessing, browsing, registering, or using OpenDukan, you agree to comply with and be legally bound by these Terms & Conditions.
ACCESSING OR USING OPENDUKAN INDICATES YOUR ACCEPTANCE OF ALL TERMS, CONDITIONS, POLICIES, AND GUIDELINES MENTIONED HEREIN.
About OpenDukan
OpenDukan is a self-service eCommerce platform that enables individuals, resellers, creators, and businesses to create online stores, list products/services, and receive customer orders directly through WhatsApp and other channels.
OpenDukan acts solely as a technology service provider and does not manufacture, own, sell, stock, or directly control products listed by sellers.
Eligibility
- You must be at least 18 years old.
- You must provide accurate information.
- You must use the platform legally and ethically.
- You must not engage in fraudulent or harmful activities.

OpenDukan shall not be responsible for transactions between buyers and sellers.

- Adult/prohibited content
- Fraudulent schemes
- Drugs or narcotics
- Copyright-infringing materials
Pricing & Payment Terms
One-Time Pricing Model
OpenDukan operates on a flexible pricing model with multiple plans designed for creators, resellers, businesses, and online sellers.
- BASIC Plan: ₹199/month (inclusive of applicable GST) – 1 Store with up to 25 products
- BUSINESS Plan: ₹399/month (inclusive of applicable GST) – 1 Store with up to 100 products
- PRO Plan: ₹2,499 (inclusive of applicable GST) – 1 Store with up to 500 products + Custom Domain Support
Definition of "Lifetime Access"
For plans promoted as "Lifetime Access", OpenDukan defines lifetime usage as a period of up to 4 (four) years from the date of purchase unless otherwise specified.
After this period, OpenDukan reserves the right to introduce renewal fees, subscription pricing, maintenance charges, or updated business models.
Existing customers will receive advance notice before any pricing structure changes become effective.
OpenDukan may evolve its pricing structure in the future to improve platform sustainability, infrastructure, features, and support services.
Payment Processing
- You agree to pay all charges associated with using OpenDukan services.
- Payments may be processed securely through trusted third-party payment gateways such as Razorpay, PhonePe, Stripe, Paytm, UPI, Net Banking, Debit/Credit Cards, or other supported providers.
- Access to premium services may be activated only after successful payment verification.
- Platform pricing may change at any time without prior notice.
- Taxes, GST, gateway fees, or government charges may apply where required.
Refund Policy
OpenDukan may offer refunds on selected services depending on eligibility, usage, and refund policy terms.
Refund requests are reviewed individually and approval is solely at the discretion of OpenDukan.
Subscription fees, setup charges, custom development services, marketing services, and digital products are generally non-refundable unless explicitly stated.
Customer Transactions
OpenDukan only provides technology tools for sellers to create and manage online stores.
OpenDukan does not directly process transactions between store owners and their customers unless explicitly mentioned.

Third-Party Services
OpenDukan integrates with WhatsApp and other third-party services.
We are not responsible for API failures, downtime, Meta restrictions, or third-party policy changes.
Intellectual Property
All OpenDukan branding, software, UI design, features, and platform technologies are protected under intellectual property laws.

Copyright & Intellectual Property Violations — Strict Policy
Absolute Prohibition on Infringing Content
You are strictly prohibited from listing, selling, advertising, or promoting any product or service on OpenDukan that infringes upon the intellectual property rights of any third party.
This includes but is not limited to:
- Counterfeit or fake products — items bearing unauthorized trademarks or brand names (e.g., fake Nike, Apple, Samsung products)
- Pirated software, apps, or digital goods — unauthorized copies or cracked versions of paid software, VPNs, streaming services, antivirus tools, or subscriptions
- Cracked accounts or login sharing — selling access to Netflix, Spotify, Canva, Adobe, ChatGPT, VPNs, or any subscription service without permission
- Copyrighted media — unauthorized copies of movies, music, ebooks, courses, paid content, or digital downloads
- Trademarked brand usage without authorization — using logos, brand names, or identities without permission
- Replica luxury goods — products marketed as replicas, copies, or inspired versions of luxury brands
Consequences of Violation
Any violation of this policy may result in immediate action without prior notice:
- Immediate store deactivation — your store may be removed instantly
- Permanent account suspension — repeated violations may permanently ban your account
- No refund policy — subscription fees will not be refunded for suspended accounts
- Reporting to authorities — OpenDukan may cooperate with legal authorities, copyright owners, and enforcement agencies
- DMCA compliance — infringing content may be removed or de-indexed from search engines

Platform Liability Disclaimer for User Content
OpenDukan is a technology platform that enables users to create digital stores and showcase products/services online.
We do not manufacture, own, control, verify, or guarantee the legality, originality, authenticity, or safety of products listed by users.
Each seller is solely responsible for the products, content, pricing, trademarks, images, and materials uploaded to their store.
⚠️ BY CREATING A STORE ON OPENDUKAN, YOU CONFIRM THAT YOU OWN OR HAVE FULL LEGAL AUTHORIZATION TO SELL ALL PRODUCTS, SERVICES, OR DIGITAL CONTENT LISTED. ANY MISREPRESENTATION OR COPYRIGHT VIOLATION MAY RESULT IN PERMANENT ACCOUNT TERMINATION AND LEGAL ACTION.
Limitation of Liability
OpenDukan shall not be liable for:
- Business losses
- Customer disputes
- Delivery delays
- Payment failures
- Loss of profits or data
Disclaimer
OpenDukan does not guarantee sales, profits, customer traffic, or business growth.
Business success depends entirely on the seller’s products, marketing, customer service, and pricing strategies.
Governing Law
These Terms shall be governed by the laws of India.
Any disputes shall be subject to the jurisdiction of courts located in Bihar, India.
